Abstract

This article analyzes current problems in implementing the mechanism of civil liability for corruption offenses in the Republic of Kazakhstan. The paper examines theoretical and practical aspects of applying civil sanctions to persons who have committed corruption acts, investigates legal grounds for compensation of damage caused by corruption and confiscation of property. The author analyzes current Kazakhstan legislation in the field of anti-corruption, identifies existing gaps and conflicts in legal regulation that prevent effective application of civil liability. Special attention is paid to problems of proving causal relationship between corruption act and damage caused, determining the amount of material harm, and recovering illegally obtained income. The article provides comparative analysis of Kazakhstan practice with international experience in applying civil legal mechanisms for combating corruption. Based on the research, proposals are formulated to improve legislation and law enforcement practice regarding implementation of civil liability for corruption offenses in the Republic of Kazakhstan.
